THE IMPORTANCE OF AN EFFICIENT INTERPRETATION OF THE CONSTITUTIONAL TEXT

Abstract

This research aimed to discuss the importance of an effective interpretation of the constitutional text and the risks associated with inadequate interpretations. Historically, the relationship between norms and concrete cases was closer, but with the evolution of Law, it has become essential to develop a systematization that allows for the proper application of norms to specific cases. The interpretation of norms must be carried out carefully, as a distorted understanding can result in legal uncertainty, which will hinder the State's ability to deliver jurisdictional protection. Therefore, the interpretation of the rights, guarantees, and duties established in the constitutional text must be well-founded in order to reduce ambiguities.
