This study, of a basic nature and qualitative approach, adopts the hypothetical-deductive method to analyze the impacts of technological advances on criminal investigation and Brazilian Criminal Law. The objective is to understand how the lack of normative adaptation and the state's technological lag compromise the effectiveness of criminal prosecution against digital crimes, through a bibliographic analysis of different authors. While other countries adopt modern legislation, Brazil still faces legal and investigative limitations. It is concluded that normative and technological modernization is essential, requiring restructuring in state agencies to make the fight against crime more efficient.
